County Assembly Clerk

The clerk should be: The chief administrative officer of the county assembly; and responsible for the day-to-day management and functioning of the county assembly.

The procedural functions of the County Assembly Clerk in Kenya include:

providing expert, non-partisan and impartial advice to the members of the county assembly on the legislative process, and parliamentary procedure and practice; and

carrying out such other duties and exercising powers as the law may confer on him or her or by the Standing Orders and practices of the County Assembly.

The County Assembly Clerk is also the Secretary to the County Assembly Service Board in accordance with the conduct and business affairs of the Board. “Secretary” means the Clerk of the county assembly or, in the absence of the Clerk, the person exercising the functions of the Clerk.

The Clerk is the only non-elected person who regularly speaks in the Assembly. He is the administrative and procedural head of the Assembly and oversees the day to day operations and affairs of the Parliament. Assisted by the Deputy Clerk and Clerk assistants the Clerk of the Assembly performs various duties including:

1. Assisting the Speaker to run the house proceedings including having thorough knowledge of the rules of the House and tabling all documents presented to the House.
2. Helping the Speaker and Members of the Assembly to organize the order of business including providing advice on House Procedure.
3. Drafting private members bills and amendments.
4. Certifying the passage of bills through the Assembly.
5. Assisting with ceremonial occasions, such as the opening of Assembly and is required to swear an oath of allegiance administered by the Speaker of the House to new Members of County Assembly.
6. Pursuant to section 12 (1) of the County Governments Acts 2012,The Clerk of the County Assembly is the secretary of the County Assembly Service Board.
7. He is the accounting officer of the County Assembly.
