EMBU COUNTY TO REGULATE ALCOHOL INDUSTRY WITH NEW LEGISLATION
The Embu County Government will be issuing fresh licenses for the production, sale, distribution consumption and outdoor advertising of alcoholic drinks upon enactment of a proposed new law.
The Embu County Alcoholic Drinks Control Bill 2019, whose legislative process has begun at the County Assembly purposes to provide a legal framework for the regulation and licensing of promotion, sale and use of alcoholic drinks in accordance with Part 2 of the Fourth Schedule of the Constitution.
The new law is aimed at ensuring the fair and ethical business practices related to the production, distribution, promotion and sale of alcohol at the same time adopting and implementing effective measures to eliminate illicit trade in alcohol; including smuggling, illegal manufacture of bootleg liquor and counterfeiting of existing brands.
The proposed law will also seek to promote research, treatment and rehabilitation of persons dependent on alcoholic drinks in order to protect the health of the individual in light of the dangers of excessive consumption of alcohol. It will at the same time protect the health of minors by preventing their access to alcohol.
The Bill will as well protect persons under the age of 18 from negative impact on health and social development from exposure to advertisements of alcoholic drinks as well as protecting the consumers of such drinks from misleading or deceptive inducements and inform them of the risks of excessive consumption of alcohol.
In addition, the legislation will inform and educate the residents of Embu County of the harmful health, economic and social consequences of alcohol consumption and put in place measures to reduce or mitigate the negative impact on communities, resulting from production, sale and consumption of alcoholic drinks.
Upon enactment, the County Government will establish a board known as the Embu County Alcoholic Drinks Control Board which will facilitate public participation on matters touching on alcohol and collaborate with other institutions to carry out research and roll out treatment and rehabilitation programmes.
The Board shall further carry out public education on alcoholic drinks control and develop strategies and plans geared towards control of alcohol abuse. It will also facilitate the functioning of sub-county committees that will be formed to ensure the implementation of the Alcoholic Drinks Control Act.
The Bill was committed to the County Assembly Trade Committee and will be subjected to public participation for key stakeholders to give their input on how best to regulate the manufacture, advertising, distribution, sale and consumption of alcohol within Embu county.
